Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the MAS CARPOOL PAKISTAN mobile application and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“App” means the MAS Carpool Pakistan mobile application.

“User”, “You” means any person who accesses or uses the Service, including drivers and passengers.

“Driver” means a User who offers a carpool ride.

“Passenger” means a User who requests or accepts a carpool ride.

“Company”, “We”, “Us”, “Our” means MAS Carpool

2. Eligibility

You must be at least 18 years old to use the Service.

You represent that you are legally capable of entering into a binding agreement.

Drivers must hold a valid driving license, vehicle registration, and insurance as required by law.

3. Nature of the Service

The App is a technology platform that enables Users to arrange carpooling.

The Company does not provide transportation services and is not a carrier or transport operator.

You must create an account to use certain features.

You agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account and all activities under it.

5. Driver Obligations

Drivers agree to:

Comply with all applicable traffic and transportation laws.

Ensure the vehicle is roadworthy and insured.

Provide truthful ride details (route, time, available seats, cost sharing if any).

Behave respectfully and safely toward Passengers.

6. Passenger Obligations

Passengers agree to:

Provide accurate pick-up and drop-off details.

Arrive on time at the agreed pick-up location.

Behave respectfully and follow reasonable instructions trom the Driver related to satety.

7. Payments

You understand that in consideration of the use of the MAS Ride Services, you will be charged and will be required to pay for the services you receive from a Third Party Service Provider (“Charges”). After you have received services obtained through your use of the MAS Ride Service, MAS Ride will facilitate your payment of the applicable Charges on behalf of the Third Party Provider. Payment of the Charges in such a manner shall be considered the same as payment made directly by you to the Third Party Provider. Charges will be inclusive of applicable taxes prescribed under the law. Charges paid by you are final and non-refundable unless otherwise determined by MAS Ride.

All Charges are due immediately and payment will be facilitated by MAS Ride using the preferred payment method designated in your Account, after which MAS Ride will send you a receipt by email. If your primary Account payment method is determined to be expired, invalid, or otherwise not able to be charged, you agree that MAS Ride may, as the Third Party Provider’s limited payment collection agent, use a secondary payment method in your Account, if available.

As between you and MAS Ride, MAS Ride reserves the right to establish, remove and/or revise Charges for any or all services obtained through the use of the MAS Ride Services at any time in MAS Ride’s sole discretion. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand. MAS Ride will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. MAS Ride may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services obtained through the use of the MAS Ride Services, and you agree that such promotional offers and discounts unless also made available to you, shall have no bearing on your use of the MAS Ride Services or the Charges applied to you. You may elect to cancel your request for services from a Third Party Service Provider at any time prior to such Third Party Service Provider’s arrival, in which case you may be charged a cancellation fee.

The payment structure provided herein is intended to fully compensate the Third Party Service Provider for the services provided. You understand and agree that, while you are free to provide additional payment as a tip/gratuity to any Third Party Service Provider who provides you with services obtained through the MAS Ride Service, you are under no obligation to do so. Tips/gratuities are voluntary. After you have received services obtained through the MAS Ride Service, you will have the opportunity to rate your experience and leave additional feedback about your Third Party Service Provider.

7.1. MAS Ride WALLET TOP-UP:

Personal Use Only: Customers and partners must use their personal accounts to top up their MAS Ride Wallet.

Platform Specific: Funds topped up to your MAS Ride Wallet are intended for use only on the MAS Ride platform and cannot be withdrawn or transferred to other accounts.

Maintain Records: Please ensure you have a clear and verifiable record of all funds you top up to your MAS Ride Wallet. This helps ensure transparency and resolves any potential discrepancies.

7.2. MAS Ride Credit:

By loading amounts in MAS Ride Credit, you acknowledge and agree that you are not depositing cash or money with MAS Ride.

Amounts shown in MAS Ride credit may not be redeemable for cash.

With the exception of bonus credits and promo credits or any such virtual amounts credited in MAS Ride credits which may have a shorter expiry period decided by MAS Ride from time to time which may extend to a maximum of 30 days or any period or date specified by MAS Ride, the amounts present in MAS Ride wallets will not expire prior to 90 days in case of customer accounts and 30 days in case of partner accounts.

After the expiry of 90 days or 30 days as the case may be, the balance not withdrawn will expire and may not be restored unless decided against within 15 days of such expiry at MAS Ride’s sole discretion or after investigating a claim to this effect brought forward by the counterparty after such expiry.

Account suspension, blockage of services, expiry and/or forfeiture of MAS Ride wallet balances may be performed earlier at MAS Ride’s sole discretion in cases that include, but are not limited to, fraud, account takeover, identity conflict, violation of terms and conditions contained herein, harassment of customers or other entities, etc.

8. Cancellations and No-Shows

Drivers and Passengers may cancel a trip at any time. However, MAS Ride does not provide any guarantee or compensation for cancellations made by either party.

Cancellation terms after booking confirmation are as follows:

8.1 Cancellation by Driver

If a trip is cancelled by the Driver, the Passenger will receive a full refund of the total amount paid, including both the fare (cost contribution) and any applicable service fees.

This also applies if the Driver fails to arrive at the agreed pickup location within 10 minutes of the scheduled time.

8.2 Cancellation by Passenger

a) More than 24 hours before departure:
The Passenger will receive a refund of the fare (cost contribution) only. Service fees are non-refundable and retained by MAS Ride. The Driver will not receive any payment.

b) Within 24 hours before departure (and more than 30 minutes after booking):
The Passenger will receive 50% of the fare. Service fees remain non-refundable. The Driver will receive 50% of the fare as compensation.

c) Within 24 hours before departure (and within 30 minutes of booking):
The Passenger will receive a full refund of the fare. Service fees are non-refundable. The Driver will not receive any payment.

d) After scheduled departure time or no-show:
If the Passenger cancels after the scheduled departure time or fails to arrive within 10 minutes of the agreed pickup time, no refund will be issued. The Driver will receive the full fare, and service fees will be retained by MAS Ride.

8.3 Rebooking of Cancelled Seats

If a Passenger cancels before departure, the cancelled seat(s) may be made available again on the platform for booking by other users, subject to these Terms.

8.4 Refund Processing

All eligible refunds will be processed within 5–7 business days and credited to the original payment method.

8.5 Discretion

MAS Ride reserves the right to review and decide on refund requests at its sole discretion, based on the circumstances and available information, including exceptional or disputed cases.

9. Prohibited Conduct

You agree not to:

Use the Service for unlawful purposes.

Provide false or misleading information.

Harass, abuse, or harm another User.

Circumvent the App to avoid fees (if applicable).

10. Ratings and Reviews

Users may provide ratings and feedback.

Reviews must be honest and non-defamatory.

The Company reserves the right to remove inappropriate content.

11. Safety and Disclaimer

Carpooling involves inherent risks.

The Company does not guarantee the identity, behavior, or reliability of Users.

Users participate at their own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

The Company shall not be liable for any indirect, incidental, or consequential damages.

The Company is not liable for accidents, injuries, losses, or disputes arising between Users.

13. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from:

Your use of the Service.

Your violation of these Terms.

Your interactions with other Users.

14. Suspension and Termination

The Company may suspend or terminate your account at any time for violation of these Terms or for safety reasons.

You may stop using the Service at any time.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use personal data.

16. Third-Party Services

The App may contain links to third-party services.

The Company is not responsible for third-party content or services.

17. Changes to Terms

We may update these Terms from time to time.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
